Zur Manipulation der Abgasreinigung haben die Hersteller verschiedene Softwares in ihren Motoren verbaut, die erkennen, wenn das Fahrzeug auf dem Prüfstand steht. Auf dem Prüfstand bleiben die Stickoxidwerte dank dessen im gesetzlichen Rahmen. Im realen Fahrverkehr sind betroffene Dieselfahrzeuge enorme Dreckschleudern und stoßen deutlich höhere Schadstoffe aus, als erlaubt. Rückrufe, Wertverlust, Fahrverbote – die Konsequenzen für betroffene Dieselfahrer sind drastisch.

Im September 2015 wurde VW von der amerikanischen Umweltschutzbehörde beschuldigt, Diesel-Fahrzeuge der Baujahre 2009 – 2015 mit einer „Schummelsoftware“ zur Manipulation der Abgasreinigung ausgestattet zu haben, um die Kontrolle zur Einhaltung der Umweltbestimmungen auf dem Prüfstand zu überlisten. Mit Hilfe unzulässiger Abschalteinrichtungen haben die Fahrzeuge ihr Abgasverhalten geändert, sobald sie auf dem Prüfstand befanden und spielten ihm einen „sauberen“ Diesel vor. Nicht nur das vorsätzlich sittenwidrige Vorgehen der Autohersteller, sondern auch das nachlässige Verhalten des Kraftfahrt-Bundesamts (KBA), das als Kontrollinstanz seiner Überwachungspflicht nicht nachgekommen ist, haben den Betrug möglich gemacht.

Millionen Dieselfahrzeuge sind von der Abgasmanipulation betroffen – und nicht nur VW-Modelle: Inzwischen ist bekannt, dass es neben VW auch einen Porsche, Audi und Daimler Dieselskandal gibt und ihre Kunden durch den Einbau der Abschalteinrichtungen betrogen haben. Die Konsequenzen für betroffene Verbraucher im Dieselskandal sind verheerend und weitreichend: Das Kraftfahrt-Bundesamt (KBA) hat bereits einige verpflichtende Rückrufe für betroffene Modelle veranlasst.

Darüber hinaus haben geschädigte Dieselfahrer mit Wertverlusten und Zwangsstilllegungen zu kämpfen. Auch die angebotenen Software-Updates zur Nachrüstung bieten keine zufriedenstellende Lösung. Nicht nur, dass die angebotenen Software-Updates mit Fahrzeugschäden in Verbindung gebracht werden, zusätzlich drohen bundesweit Fahrverbote. Denn: Trotz Software-Updates bleiben die betroffenen Dieselmotoren „schmutzig“, da die Updates lediglich die illegalen Software-Teile beseitigen, der Motor aber auf die gleiche Art verbrennt wie zuvor.

In den vergangenen Jahren wurden die von der EU vorgegebenen Grenzwerte für Stickoxide (40 Mikrogramm pro Kubikmeter) in deutschen Städten und Ballungsräumen um ein Vielfaches überschritten. Vor allem alte Diesel-PKW stoßen vermehrt giftige Stickoxide (NOx) aus, die ein Gesundheitsrisiko für Mensch und Umwelt darstellen. In erster Linie sind Dieselautos mit der Schadstoffklasse Euro 5 oder schlechter von den Fahrverboten betroffen. Die Details hierzu werden von jeder Stadt im jeweiligen Luftreinhalteplan festgelegt. Da jedoch die zulässigen Grenzwerte inzwischen auch bei Euro 6-Autos vielerorts nicht eingehalten bzw. weit überschritten werden, wird es vermutlich bereits im Jahr 2020 erweiterte Fahrverbote geben. Die Deutsche Umwelthilfe (DUH) warnte Verbraucher bereits 2018 davor, sich einen Euro 6-Diesel zuzulegen, da Fahrverbote aufgrund kontinuierlicher Grenzwertüberschreitungen mittelfristig unvermeidbar sind.

Als der Dieselskandal 2015 von der US-Umweltschutzbehörde aufgedeckt wurde, versicherte Dieter Zetsche, damals noch Daimler-Chef, dass betrügerische Abgasmanipulationen „bei Daimler undenkbar” seien, dass der Daimler Dieselskandal undenkbar sei. Inzwischen ist klar, dass das nicht stimmt: Auch Mercedes hat illegale Abschalteinrichtungen in seinen Diesel-Fahrzeugen verbaut, um die Abgaswerte auf dem Prüfstand niedrig zu halten. Ein Streitpunkt ist das sog. „Thermofenster“, eine Softwarefunktion, die die Abgasreinigung bei niedrigen und erhöhten Temperaturen reduziert oder drosselt. Dies hat zur Folge, dass die Dieselfahrzeuge auf dem Prüfstand zwar emissionsarm wirken, auf der Straße jedoch deutlich höhere Schadstoffe ausstoßen, als erlaubt. Die Staatsanwaltschaft ermittelt seit März 2017 wegen vorsätzlichem Betrug und strafbarer Werbung gegen den Konzern. Daimler argumentiert, dass diese Funktionen legitim seien, da sie dazu dienen, den Motor zu schonen, um Schäden wie Belagsbildung und Korrosion im Abgastrakt bei starken Temperaturschwankungen zu verhindern. Diese Argumentation konnte von Daimler bislang jedoch nicht hinreichend erläutert werden und bleibt weiterhin fragwürdig. Die Justiz bewertet das Thermofenster bei der Abgasreinigung vermehrt als unzulässige Abschalteinrichtung.

Nach Einigung mit dem Kraftfahrt-Bundesamt (KBA) hat Mercedes im Rahmen seiner sog. „freiwilligen Kundendienstmaßnahme“ europaweit freiwillig 3,6 Millionen Diesel-Fahrzeuge zurückgerufen, die durch ein Software-Update nachgerüstet werden sollten. Der Autobauer schenkt hierfür seinen Kunden 100 Euro Gutscheine. Das Software-Update sollte für alle Mercedes Diesel-Fahrzeuge gelten und nicht nur für die, die vom Rückruf betroffen sind. Bei einer Untersuchung der vorgenommen Softwareupdates kam heraus, dass nicht nur die bereits entdeckten Manipulationen beseitigt wurden, sondern dass eine zusätzliche Stelle im Programmiercode geändert wurde. Vieles deutet darauf hin, dass Daimler diese zusätzliche Manipulation heimlich und diskret im Rahmen jener freiwilligen Kundendienstmaßnahme entfernt hat.

Daimler wird vorgeworfen, die Abgasreinigung mit mehreren Motorsteuerungsfunktionen zu manipulieren. Das sogenannte „Thermofenster“ ist eine höchst umstrittene Software-Funktion zur Kühlmittel-Sollwert-Temperaturregelung. Die Software ist so programmiert, dass sie die Abgasreinigung bei erhöhten Motortemperaturen abschaltet. Dadurch wird der Kühlmittelkreislauf des Motors künstlich kalt geschaltet und das Aufwärmen des Motoröls verlangsamt. Das hat zur Folge, dass die Stickoxidwerte auf dem Prüfstand im gesetzlichen Rahmen bleiben – allerdings nur dort: Auf der Straße sind die betroffenen Dieselfahrzeuge enorme Dreckschleudern und stoßen deutlich höhere Schadstoffe aus, als erlaubt. Mittels Slipguard erkennen Fahrzeuge durch ihre Beschleunigungs- und Geschwindigkeitswerte, dass sie sich gerade auf dem Prüfstand befinden. Bit 15 schaltet nach ca. 26 km die Abgasnachbehandlung aus. Das hat zur Folge, dass der saubere Modus verlassen wird und giftige Stickoxide freigesetzt werden. Besonders in Ballungsgebieten sind diese hohen Abgaswerte kritisch für die Umwelt und unsere Gesundheit.

Als der Dieselskandal 2015 aufgedeckt wurde, versicherte Dieter Zetsche, damals noch Daimler-Chef, dass betrügerische Abgasmanipulationen „bei Daimler undenkbar” seien. Inzwischen ist klar, dass das nicht stimmt: Auch Mercedes hat unzulässige Software in seinen Diesel-Fahrzeugen verbaut, um die Abgaswerte auf dem Prüfstand niedrig zu halten. Nachdem das Kraftfahrt-Bundesamt (KBA) bereits im vergangenen Jahr einen Rückruf für rund 680.000 betroffene Mercedes-Fahrzeuge anordnete, wurde im April sogar ein formelles Anhörungsverfahren wegen des Verdachts auf eine weitere unzulässige Abschaltvorrichtung gegen Daimler eingeleitet. Hintergrund dieser Maßnahme ist die umstrittene Software-Funktion zur sog. Kühlmittel-Sollwert-Temperaturregelung, auch „Thermofenster“ genannt. Die Software ist so programmiert, dass sie die Abgasreinigung bei erhöhten Motortemperaturen abschaltet. Dadurch wird der Kühlmittelkreislauf des Motors künstlich kalt geschaltet und das Aufwärmen des Motoröls verlangsamt. Das hat zur Folge, dass die Stickoxidwerte auf dem Prüfstand im gesetzlichen Rahmen bleiben – allerdings nur dort: Auf der Straße sind die betroffenen Dieselfahrzeuge enorme Dreckschleudern und stoßen deutlich höhere Schadstoffe aus als erlaubt. Damit nicht genug, wurden bei Untersuchungen noch weitere ungeheuerliche Funktionen entdeckt, mit denen Daimler die Messungen auf dem Prüfstand manipuliert haben soll: „Bit 15“ und „Slipguard“.

Bit 15 schaltet nach ca. 26 km die Abgasnachbehandlung aus. Mittels Slipguard erkennen Fahrzeuge durch ihre Beschleunigungs- und Geschwindigkeitswerte, dass sie sich gerade auf dem Prüfstand befinden. Daimler argumentiert, dass diese Funktionen legitim sind, da sie dazu dienen, den Motor zu schonen, um Schäden wie Belagsbildung und Korrosion im Abgastrakt zu verhindern. Nachdem Experten des KBA bereits fünf illegale Abschalteinrichtungen in der Software entdeckt haben, wäre Daimler in der Pflicht gewesen, alle weiteren unzulässig verbauten Abschalteinrichtungen selbstständig zu melden. Nun kam jedoch heraus, dass bei den vorgenommenen Softwareupdates nicht nur die bereits entdeckten Manipulationen beseitigt wurden, sondern dass eine zusätzliche Stelle im Programmiercode geändert wurde. Vieles deutet darauf hin, dass Daimler diese zusätzliche Manipulation heimlich und diskret im Zuge der Softwareupdates, die als freiwillige Kundendienstmaßnahmen getarnt waren, entfernt hat. Dies wäre eine Straftat. In seinem Schreiben vom 04.04.2019 fordert das KBA Daimler auf, Stellung zu beziehen und schildert die Manipulationsmethode des Konzerns ausführlich.Daimler weist diese Vorwürfe zurück. Nach eigenen Angaben kooperiert das Unternehmen „vollumfänglich“ mit dem KBA.

Im Jahr 2017 gab es zunächst einen freiwilligen Rückruf in Absprache mit dem Kratffahrt-Bundesamt (KBA) seitens Daimler. Seitens Mercedes sollten über drei Millionen Fahrzeuge mit einem Softwareupdate weniger schädliche Stickoxide ausstoßen. So sollte Druck aus der Diesel-Diskussion genommen und Vertrauen geschafft werden.
2018 gab es einen ersten offiziellen Rückruf für etwa 6.000 Fahrzeuge des Modells Mercedes Vito der Abgasnorm Euro 6. Wenig später, im Sommer 2018, wurden in einem zweiten Rückruf ca. 700.000 Fahrzeuge zurückgerufen, die mit einem Software-Update nachgerüstet werden sollten. Im Juni 2019 hat das Kraftfahrt-Bundesamt (KBA) einen verpflichtenden Rückruf für ca. 60.000 Mercedes-Fahrzeuge des Modells GLK 220 CDI der Baujahre 2012-2015 mit Abgasnorm Euro 5 angeordnet. Zudem kam heraus, dass die unzulässige Software flächendeckend in den Motoren OM 651 und OM 642 eingesetzt wurde, d.h. ebenfalls in Volumenfahrzeugen der C-, E- und S-Klasse. Daimler hat dies bestätigt. Erst im Oktober 2019 muss Mercedes eine “mittlere sechsstellige Anzahl von Fahrzeugen in Europa” zurück rufen, die einen OM651 Motor verbaut haben. Zu den betroffenen Fahrzeugen gehören auch 260.000 Sprinter.
Kurze Zeit später fordert das KBA einen Rückruf für weitere 1.700 Mercedes-Fahrzeuge der Reihe GLE, GLS und EQC.
Darüber hinaus umfasst der verpflichtende Rückruf des KBA folgende Mercedes-Benz Diesel-Fahrzeuge der Abgasnorm Euro 6b.

Im Sommer 2017 hat Daimler im Rahmen einer „freiwilligen Kundendienstmaßnahme“ mit Software-Updates zur Nachrüstung betroffener Dieselfahrzeuge begonnen. Europaweit sollte rund 3,6 Millionen Daimler Dieselskandal Fahrzeuge das neue Update aufgespielt werden, um den Schadstoffausstoß zu senken. 2018 stellte das Kraftfahrt-Bundesamt (KBA) eine unzulässige Abschalteinrichtung bei der Abgasreinigung fest und verlangte den Rückruf für ca. 700.000 Mercedes Diesel (Autos und Vans). Das Software-Update bringt geschädigte Verbraucher in eine prekäre Lage: Entscheiden Sie sich dafür, nehmen sie durch das Aufspielen des Updates mögliche Fahrzeugschäden in Kauf. Entscheiden sie sich dagegen, drohen wiederum Fahrverbote und der Entzug der Betriebserlaubnis. Da das Software-Update kostenfrei aufgespielt wird, weigert sich Daimler, für etwaige Schäden zu haften.

Das KBA hat im August 2019 eine Erlaubnis für die Hardware-Nachrüstung von Fahrzeugen im Daimler Dieselskandal erteilt. Der Stickoxidausstoß muss durch die Hardware-Nachrüstung auf 270 Milligramm Stickoxid je Kilometer gesenkt werden. Daimler hat angekündigt, sich in Schwerpunktregionen mit Zuschüssen von bis zu 3.000 Euro pro Kunde an den Kosten zur Hardware-Nachrüstung für Euro-5-Dieselfahrzeuge zu beteiligen. Die vom KBA genehmigten Nachrüstsysteme können in Mercedes-Modellen der E- und C-Klasse und im SUV GLK mit der Abgasnorm Euro 5 eingebaut werden. Betroffenen Verbrauchern, die sich für eine Hardware-Nachrüstung entscheiden, sollte jedoch bewusst sein, dass jede Umrüstung einen technischen Zustand herstellt, der vom Hersteller so nicht vorgesehen war.

Abstreiten, Ausflüchte, keinerlei Selbstkritik: der Konzern hat den Daimler Dieselskandal schlecht gemanagt und viele Fragen offengelassen. Seitdem der Daimler Dieselskandal beim Konzern publik wurde, besteht die Krisenkommunikation bei Daimler weitestgehend darin, alles abzustreiten. Bis heute hält das Unternehmen an Ex-Chef Dieter Zetsches Aussage von 2015 fest, dass bei Daimler im Daimler Dieselskandal nicht manipuliert wurde. Ein Grund hierfür ist, dass ein Schuldeingeständnis die Erfolgschancen von Verbraucherklagen drastisch erhöhen würde. Schon jetzt gehen die Schadensersatzforderungen in die Millionen. Daimlers bisheriges Vorgehen, gegen jede Entscheidung juristische Mittel einzulegen, hat Kalkül: Solange ist der Konzern im rechtlichen Sinne weiterhin unschuldig. Mit dieser Kommunikationsstrategie verfolgt Daimler außerdem das Ziel, seine Reputation zu schützen: Wer einen Mercedes kauft, zahlt schließlich auch für den Status – Prestige und Betrug passen da nicht gut zusammen. Viel wird von diesem exklusiven äußeren Schein nicht übrig bleiben, wenn die einzige Reaktion des Konzerns darin besteht, die Manipulation im Dieselskandal weiter abzustreiten und gegen jede Entscheidung zu klagen, obwohl andere Autohersteller mit denselben Softwaretricks den Betrug bereits eingeräumt haben. Inzwischen ist längst bekannt, dass auch Mercedes unzulässige Software in seinen Dieselautos verbaut hat, um die Abgaswerte auf dem Prüfstand gering zu halten: Auf dem Prüfstand waren die Fahrzeuge sauber, auf der Straße verschmutzten sie jedoch in hohem Maße die Luft. Vielleicht hat der Konzern gehofft, unbeschadet aus dem Daimler Dieselskandal herauszugehen, wenn nur lange genug Gras über die Sache gewachsen ist und die Manipulationsvorwürfe oft genug abgestritten werden. Der Bundesverkehrsminister Scheuer (CSU) zeigt sich empört und spricht nach den weiteren Rückrufen im Jahr 2019 von einer “Salamitaktik” des Autobauers. Er kritisiert besonders den Daimler-Konzernchef Ola Källenius: „Der neue Daimler-Vorstandsvorsitzende hat mir vor Monaten versichert, dass er bei unzulässigen Abgastechniken reinen Tisch machen wird. Leider ist das Gegenteil der Fall“.
